Your use of the platform is subject to all additional conditions, guidelines, rules or policies applicable to services or certain features of the platform that we can publish or lay off on the platform (together the “Additional Conditions”). B such as end-user licensing agreements or other agreements or rules applicable to certain features, promotions or content on the platform, including, without any restrictions, the additional terms of use of Google Maps/Google Earth that are maps.google.com/help/terms_maps.html and Google`s privacy policy www.google.com/intl/ALL/policies/privacy/index.html. All these additional conditions are added to this agreement by reference. Grubhub CEO Matt Maloney reacted to reports that his company created fake websites for its restaurant partners, claiming that the companies signed Grubhub`s permission to participate in marketing tactics on their behalf in accordance with their contractual agreements. According to a partial Contract of Grubhub obtained by the Los Angeles Times, a provision states that Grubhub can “create, maintain and operate a microsite (MS) and recover the URL for these MS on behalf of the restaurant.” Any waiver of Grubhub for the duration of this contract must be made in writing. If part of the agreement is found to be null, null or void, that part is considered separable and, as far as possible, replaced by a valid, applicable provision in accordance with the intent of the original provision as close as possible, except that in the event that the collective action waiver is not applied, the entire arbitration agreement is not applicable. The remainder of this agreement remains enforceable and applies on the terms of the agreement. Arbitration is managed by the American Arbitration Association (“AAA”). Except in the provision amended by this dispute settlement provision, the AAA will manage the arbitration process either on the terms of (A) of the commercial arbitration then in force or (B) of the consumer arbitration rules, if it is a “consumer” agreement within the meaning of Rule R-1 (together the “applicable AAA rules”).
